Wills & Probate

Wills & Probate | E. Erotokritou & CO

There is no legal obligation to have a will in Cyprus but we always advise our clients to have one because this is how you legally express your wish as to the future allocation of your assets.

A will should be simple, precise and specific. For safety reasons and to avoid any doubts as to its authenticity and the contents of it, it is advisable for the original of the will to be deposited with the registrar of the court.

Things to know before you make up your decision:

- Using the wrong wording could mean that your instructions aren’t followed or even that your will isn’t valid
- You should have a will if you have people who are financially dependent on you other than your immediate family
- Strict adherence to the formalities as provided by law is necessary in order for a will to be valid
- A will may always be revoked by a new will expressly revoking the former one, or by a subsequent inconsistent will or by destroying the will by the testator
- A new will is required (a) after the marriage of the testator or (b) after the birth of a testator’s child, if at the time of signing the will the testator had no child
- There is no inheritance tax in Cyprus
- Unmarried partners and partners who have not registered a civil partnership cannot inherit from each
other unless there is a will
- If you are getting a divorce you may need to check your will again

The list is not exhaustive therefore please feel free to contact us and a member of our firm will be more than happy to answer any question you may have.
